You may purchase the Program for a single payment of $147, unless a different promotional price is expressly offered at checkout.
Alternatively, You may select a payment plan consisting of four payments of $47, totaling $188.
The first payment is due at checkout. The remaining payments will be charged automatically according to the payment schedule disclosed at checkout.
By selecting the payment plan, You authorize the Company to charge Your payment method for all scheduled installments.
Payment Plan Obligations
The payment plan is an installment arrangement for the purchase of the complete digital curriculum. It is not a monthly membership or a cancelable subscription.
By selecting the payment plan, You agree to pay the entire purchase price of $188, even if You choose not to use or complete the Program.
Failure to access, download, or use the curriculum does not release You from Your payment obligations.
The Company reserves the right to suspend or terminate access to the Program if a scheduled payment is declined, disputed, or otherwise unsuccessful.
Continued access to the Program requires successful completion of all scheduled payments.
To the extent permitted by applicable law, outstanding payment obligations remain due even if access is suspended or terminated because of nonpayment or a violation of these Terms.
Access to the Program
Upon successful purchase, You will receive digital access to Building Primary Writers through the Company's designated online platform.
The Program is delivered digitally. No physical materials will be shipped unless expressly stated otherwise.

Access is provided for as long as the Company continues to maintain and offer the Program through its designated platform, unless otherwise expressly guaranteed in writing.
The Company reserves the right to change the hosting platform, delivery method, or organization of the curriculum.
If the Company intends to permanently discontinue access to the Program, it will endeavor to provide at least 30 days' advance notice and a reasonable opportunity to download available materials.

Unless a separate written licensing agreement provides otherwise, each individual teacher who uses the curriculum must have their own teacher license.
A school or district purchasing a single license may not distribute the curriculum to multiple educators.
Schools and districts seeking access for multiple teachers must purchase the appropriate number of licenses or obtain a separate licensing agreement from the Company.

- You will receive access to downloadable curriculum materials.
- You have had the opportunity to review the Program description, curriculum previews, and Scope & Sequence before purchasing.
- You understand the individual teacher licensing restrictions.
- You understand and agree to the payment obligations associated with Your selected payment option.

You may not reproduce, publish, distribute, sell, sublicense, create unauthorized derivative products from, or otherwise commercially exploit Program materials without prior written permission.
Unauthorized use may result in immediate termination of access and revocation of the license, without refund, to the extent permitted by law.

You are responsible for maintaining the confidentiality of Your account credentials.
Your account is intended solely for the individual educator associated with the purchased license.
You agree not to share account access with colleagues, staff members, or other individuals.
The Company reserves the right to restrict or terminate accounts associated with unauthorized access or credential sharing.
Personal Responsibility
By purchasing and using Building Primary Writers, You accept responsibility for implementing the curriculum in a manner appropriate for Your students, instructional setting, and applicable educational requirements.
The Company does not guarantee specific academic outcomes, student achievement levels, assessment results, or improvements in writing performance.
Student progress may vary based on instructional implementation, individual learning needs, classroom conditions, and other factors outside the Company's control.
You agree to exercise professional judgment when selecting, adapting, and implementing instructional activities.

The Company does not claim ownership of original materials, comments, feedback, or other information You voluntarily submit in connection with the Program.
By submitting feedback, testimonials, suggestions, or other content to the Company, You grant the Company a non-exclusive, royalty-free license to use, reproduce, and display such submissions in connection with its business operations and promotional materials, subject to applicable privacy laws.
You represent that You have the necessary rights and permissions to submit such materials.
You must not submit personally identifiable student information, student work containing identifying details, or other protected educational records without obtaining all necessary permissions.

The Company makes reasonable efforts to provide accurate, effective, and accessible educational resources.
However, the Program and its materials are provided on an “as is” and “as available” basis, to the extent permitted by applicable law.
The Company makes no guarantee that the Program will be uninterrupted, error-free, compatible with every device or platform, or suitable for every educational setting.
To the fullest extent permitted by applicable law, the Company disclaims warranties not expressly provided in this Agreement, including implied warranties of merchantability and fitness for a particular purpose.
Limitation of Liability
To the fullest extent permitted by applicable law, the Company shall not be liable for indirect, incidental, special, consequential, or punitive damages arising from the purchase, access, or use of the Program.
This includes, without limitation, loss of data, business interruption, technology-related issues, or educational outcomes resulting from implementation of the curriculum.

The Company reserves the right to suspend, restrict, or terminate Your access to Building Primary Writers if You:
- Fail to complete required payments.
- Share account credentials or curriculum materials without authorization.
- Violate the individual teacher license.
- Redistribute, resell, or publicly post protected materials.
- Infringe upon the Company's intellectual property rights.
- Engage in fraudulent or otherwise prohibited conduct.
- Materially violate any provision of this Agreement.
Where permitted by applicable law, termination resulting from a violation of these Terms does not entitle You to a refund or release You from outstanding payment obligations.
The Company may also refuse future purchases or access where reasonably necessary to protect its intellectual property, customers, or business operations.
Entire Agreement
This Agreement, together with the Company's Terms of Use, Privacy Policy, Disclaimer, and any applicable written licensing agreement, constitutes the entire agreement between You and the Company regarding Building Primary Writers.
It supersedes prior or contemporaneous communications relating to the Program, except for express written agreements executed by the parties.
Severability
If any provision of this Agreement is found to be invalid, illegal, or unenforceable, the remaining provisions shall remain in effect to the fullest extent permitted by law.
Waiver
Failure by the Company to enforce any provision of this Agreement shall not constitute a waiver of its right to enforce that provision or any other provision in the future.
Any waiver must be expressly provided in writing.
Force Majeure
The Company shall not be responsible for delays or failures in performance resulting from circumstances beyond its reasonable control, including natural disasters, governmental actions, emergencies, labor disruptions, internet outages, hosting platform interruptions, or other unforeseen events.
